CANCELLATION POLICY

This Cancellation & Refund Policy ("Policy") governs cancellations, refunds, and payment-related rights and obligations for products and services offered by MyFunded Futures, LLC ("Company," "we," "our," or "us"). This Policy is incorporated into and forms an integral part of the Company's General Terms & Conditions (the "Terms"). Capitalized terms not defined herein shall have the meanings assigned to them in the Terms.

By purchasing, accessing, or using any Company products or Services, you acknowledge and agree to be bound by this Policy and the Terms.

1. REFUND ELIGIBILITY

1.1. Eligibility for Refund

Refunds are available only if all of the following conditions are met:

  • You purchased an account, product, or Service directly from the Company;
  • No trading activity has occurred on the account, including placing trades, opening positions, or accessing market data;
  • Your refund request is submitted within fourteen (14) days of the original purchase date; and
  • You submit your request to [email protected].

1.2. Refund Amount

Eligible refunds will be issued as:

The amount paid minus a non-refundable USD $75.00 fee, which covers technology, platform, and market data costs incurred by the Company.

1.3. Method of Refund

Refunds will be issued to the original method of payment. A confirmation email will be provided once the refund is processed.

2. PAYMENTS FOR PRODUCTS AND SERVICES

2.1. Payment for Products, Services, Subscriptions, and Access

The Company may offer products, Services, subscriptions, or access to portions of the Website at a monetary cost. Except for Services or subscriptions subject to recurring billing provisions in the Terms:

  • all prices and availability may change at any time without notice,
  • promotions may not apply retroactively.

Purchases may occur:

  • directly through the Website; or
  • through a third-party affiliate or external provider.

If redirected to a third-party:

  • your purchase may be governed by that provider's terms,
  • you are solely responsible for reviewing such terms,
  • the Company assumes no liability for third-party claims, failures, or disputes.

2.2. Order Placement and Payment Processing

By placing an order, you agree to:

  • pay the price stated on the order summary or checkout page,
  • authorize the Company and its payment processors to charge your selected payment method,
  • assume responsibility for all purchases made under your account.

Payment processors may impose additional terms. The Company is not responsible for:

  • processor downtime,
  • rejected payments,
  • processor errors,
  • or resulting damages.

Unauthorized or fraudulent payment methods may result in suspension or termination.

2.3. Delivery of Purchased Products and Services

Upon successful payment:

  • products, Services, or access will be provisioned immediately;
  • digital delivery is deemed complete when access is granted—not when first used;
  • confirmation will be delivered via email.

Failure to log in, use the product, or complete an evaluation does not affect delivery status.

2.4. Refunds and Cancellations

Unless expressly stated otherwise:

All one-time purchases for products, Services, subscriptions, or access are strictly non-refundable.

This includes:

  • evaluations,
  • resets,
  • upgrades,
  • software access,
  • market data,
  • platform fees,
  • account fees.

Recurring purchases may be canceled pursuant to the Billing section of the Terms. Past payments are non-refundable, and future billing stops only if canceled with sufficient notice.

2.5. Third-Party Terms

If a purchase uses a third-party payment system:

  • their terms govern the transaction;
  • the Company is not responsible for third-party performance or errors;
  • you assume all risks associated with external processors.

The Company disclaims all liability related to third-party platforms, payment gateways, and checkout environments.

3. NON-REFUNDABLE CIRCUMSTANCES

Refunds will not be issued under any of the following:

  • You engaged in any trading activity, including opening positions or accessing market data;
  • Your refund request is outside the 14-day window;
  • You purchased a non-refundable product or Service;
  • The Company terminated your account for violating the Terms or Trading Rules.

Once any trading activity occurs, all fees are fully earned.

4. ACCOUNT CANCELLATION

4.1. User-Initiated Cancellation

You may request cancellation at any time by emailing [email protected]

Upon cancellation:

  • access to Services will be terminated,
  • no refunds will be issued for prior payments,
  • recurring billing stops only if notice is received at least three (3) business days prior to renewal.

4.2. Effect of Cancellation

Cancellations take immediate effect unless otherwise stated. Users are not entitled to:

  • prorated refunds,
  • reinstatement of access,
  • transfer or roll-over of unused time.

5. TERMINATION BY COMPANY

5.1. Grounds for Termination

The Company may terminate accounts immediately for:

  • violations of the Terms,
  • violations of Trading Rules,
  • fraudulent or suspicious activity,
  • unauthorized payment methods,
  • reputational harm to the Company,
  • legal, regulatory, or compliance issues.

Such determinations shall be in the Company's sole and absolute discretion.

5.2. Effects of Termination

Upon termination:

  • access will cease immediately;
  • no refunds will be provided;
  • balances, payouts, and account progress may be forfeited;
  • permanent bans may be imposed.

6. DISPUTE RESOLUTION FOR PAYMENT ISSUES

You agree to:

  • First attempt to resolve any payment dispute directly with the Company; and
  • Submit all payment-related concerns to [email protected] prior to initiating any chargeback, arbitration, or external dispute.

Payment disputes not resolved internally will follow the arbitration and dispute procedures outlined in the Terms.

7. PAYMENT DISPUTE WAIVER / CHARGEBACK PROHIBITION

By purchasing Company Services:

  • you waive all rights to dispute or reverse charges through your bank or card issuer, except as required by law;
  • chargebacks may result in immediate termination, forfeiture of balances, and legal action.

This clause is intended to prevent abuse of external dispute systems.

8. INCORPORATION BY REFERENCE

All terms related to:

  • arbitration and JAMS procedures,
  • class action and jury-trial waiver,
  • indemnification,
  • limitation of liability,
  • force majeure,
  • governing law and jurisdiction,
  • Privacy Policy,
  • Billing and recurring payments,
  • Trading Rules,
  • prohibited conduct,
  • and all other provisions

are incorporated by reference from the Company's Terms & Conditions and apply fully to this Policy. In the event of any conflict, the Terms shall control.
